Judge Gilstrap shows his work when calculating enhanced damages on remand. For anyone looking at enhanced damages and ongoing royalties, this case is illustrative.  Sounding somewhat ominous, Judge Gilstrap explains the limits of a FRAND determination and the boundaries the court will not cross.

The requirement for Infringement contentions varies from judge to judge even when the rule is exactly the same. Judge Schroeder adds to our knowledge by providing important and specific guidance on the scope of infringement contentions.

In the Western District, Judge Albright continues to refine his local rules and issue procedural rulings. From protective orders to confidentiality designations, these procedural opinions are invaluable for those practicing in his court. My favorite opinion this week revolves around his view of 30(b)(6) topics. The opinion includes a list of 30(b)(6) topics that I wouldn’t advise using.
