27th Annual BTLJ-BCLT Symposium: From the DMCA to the DSA—A Transatlantic Dialogue on Online Platform Liability and Copyright Law

With the adoption of both the Directive on Copyright and Related Rights in the Digital Single Market (CDSM) and the Digital Services Act (DSA), the European Union has moved away from the notice-and-takedown model for copyright enforcement and content moderation. This symposium will feature scholars, policymakers, and industry participants from both sides of the Atlantic assessing the ramifications of the shift to a more regulatory approach with a particular focus on copyright.
While US-based copyright professionals may be aware that Article 17 of the CDSM has changed ground rules for certain hosting providers, the implications of the DSA’s platform regulation for copyright policy has thus far been underexplored. Furthermore, the DSA is a novel and very complicated regulatory regime that will affect virtually every platform that reaches European customers. At this symposium, we are very excited to present:
- a special tutorial session led by five expert European participants who will explain the many features of the DSA
- a leading European Council official delivering the opening keynote
- expert panelists discussing the implications of the DSA for copyright enforcement.
The symposium will also address two central and related questions. First, is a new US/EU consensus possible in the wake of the EU’s departure from notice and takedown? Second, how will the “Brussels Effect” influence ongoing digital copyright and platform regulation policy debates in the United States?
